Basic Information About Driver's License Suspension
Usually, the driver's license suspension period does not begin until your DUI case is resolved, either via an Accelerated Rehabilitative Disposition, a guilty plea or a guilty verdict.
If you refuse a Breathalyzer test, a urine test or a blood test, then your driver's license may be suspended for a year — even if you ultimately beat the DUI charges. This type of suspension is possible due to a Pennsylvania law called "implied consent," whereby every Pennsylvania driver automatically consents in advance to take a breath, blood or urine test if requested by law enforcement. Breath test refusal can result in automatic driver's license suspension of one year. This may happen regardless of your ultimate innocence, and may start well before your DUI case is resolved.
Depending on the circumstances of your case, it may be possible to get an occupational driver's license, sometimes known as a hardship license or "bread-and-butter license."
